Welcome to Zabar.store!

These Terms and Conditions ("Terms") govern your access to and use of the Zabar.store website, services, and applications (collectively, the "Platform"). Please read these Terms carefully before using our Platform.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access or use the Platform.

1. Definitions

• "Platform," "We," "Us," "Our" refers to Zabar.store, its owners, operators, and affiliates.

• "User," "You," "Your" refers to any person or entity accessing or using the Platform.

• "Seller" refers to a User who registers an account to create a store and list products or services for sale on the Platform.

• "Buyer" refers to a User who registers an account to browse and purchase products or services from Sellers on the Platform.

• "Content" refers to any text, images, graphics, logos, audio, video, product descriptions, reviews, and other data uploaded to the Platform by any User.

2. Account Registration

• To use certain features of the Platform, you must register for an account.

• You agree to provide accurate, current, and complete information during the registration process.

• You are responsible for safeguarding your account password and for all activities that occur under your account.

• You must notify us immediately of any unauthorized use of your account.

3. Relationship Between Zabar.store, Sellers, and Buyers

Zabar.store is a Marketplace. We provide a digital platform that connects Sellers with Buyers. We are not a party to the actual transaction between the Seller and the Buyer. The contract for the sale is directly between the Seller and the Buyer.

4. Seller Terms and Responsibilities

By creating a Seller account, you agree to the following:

4.1. Product Listings and Content:

• You are solely responsible for the accuracy, quality, legality, and description of the products you list.

• You guarantee that all content you upload (images, descriptions, etc.) is yours or you have the right to use it, and it does not infringe on any third-party intellectual property rights.

• You agree not to list prohibited items, including but not limited to: illegal goods, counterfeit items, hazardous materials, stolen goods, and items that violate any law or regulation.

4.2. Product Compliance:

• You are responsible for ensuring your products comply with all applicable laws, standards, and regulations (e.g., safety, labeling, consumer protection laws).

• You are solely responsible for any product liability issues arising from your products.

4.3. Order Fulfillment:

• You are responsible for processing orders, shipping products, and handling returns and refunds in a timely and professional manner, in accordance with your own store policies which must be clearly displayed to Buyers.

• You must maintain adequate stock to fulfill orders.

4.4. Customer Service:

• You are the primary point of contact for Buyers regarding product inquiries, order status, returns, and complaints. Zabar.store may assist in facilitating communication but is not liable for Seller-level customer service.

4.5. Fees and Payments:

• You agree to pay all applicable fees associated with selling on the Platform (e.g., commission fees, transaction fees) as outlined in a separate Fee Schedule or at the point of sale.

• Zabar.store will remit the sale proceeds (minus our fees) to you according to our stated payment schedule.

4.6. Taxes:

• You are solely responsible for collecting, reporting, and remitting any and all taxes (such as sales tax, VAT, GST) applicable to your sales on the Platform.

5. Buyer Terms and Responsibilities

By creating a Buyer account, you agree to the following:

• You are responsible for reading the product description and Seller policies carefully before making a purchase.

• You agree to provide accurate shipping and payment information.

• All purchases are made directly from the Seller, and any issues regarding product quality, shipping delays, or returns must be addressed with the Seller first, according to their policies.

• You are responsible for the payment of the products you purchase, including any applicable taxes and shipping costs.

6. Payments and Financial Terms

• All financial transactions are processed through our designated third-party payment gateways.

• By providing payment information, you represent and warrant that you are authorized to use the payment method.

• Zabar.store reserves the right to hold funds, suspend payouts, or take other financial actions to investigate suspicious activity, resolve disputes, or enforce these Terms.

7. Intellectual Property

• The Zabar.store Platform, its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

• Sellers retain all intellectual property rights to their own product images and descriptions. By uploading content, you grant Zabar.store a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content on the Platform for the purpose of operating and promoting the marketplace.

8. Prohibited Activities

You agree not to:

• Use the Platform for any illegal or unauthorized purpose.

• Violate any laws in your jurisdiction.

• Infringe upon the intellectual property rights of others.

• Upload malicious code, viruses, or engage in any activity that disrupts the Platform's operation.

• Harass, abuse, or harm other Users.

• Use the Platform to facilitate money laundering or fraud.

9. Limitation of Liability

To the fullest extent permitted by law, Zabar.store shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from:

• Your use or inability to use the Platform.

• Any transactions between Sellers and Buyers, including product quality, safety, or legality.

• Any unauthorized access to or alteration of your transmissions or data.

• Statements or conduct of any third party (i.e., Sellers or Buyers) on the Platform.

10. Indemnification

You agree to indemnify and hold harmless Zabar.store and its affiliates, directors, officers, and employees from any claim, demand, damage, or loss (including reasonable attorneys' fees) made by any third party due to or arising out of:

• Your use of the Platform.

• Your violation of these Terms.

• Your violation of any law or the rights of a third party.

• (For Sellers) The products you sell, including any product liability claims.

11. Termination

• We may suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other Users, us, or third parties, or for any other reason.

• You may terminate your account at any time by contacting us.

12. Dispute Resolution

• Buyer-Seller Disputes: Buyers and Sellers are encouraged to resolve disputes directly between themselves. Zabar.store may provide a dispute resolution tool to facilitate this process but is not obligated to intervene and is not a party to the dispute.

• Disputes with Zabar.store: Any dispute arising from your use of the Platform shall be governed by the laws of [Your Country/State], without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
